ELIGIBILITY FOR STATE DISABILITY INSURANCE

• An employee is unable to work for at least eight consecutive days due to his disability.

• A person should be currently employed or actively looking for a job at the time he became disabled.

• A claimant should have lost wages due to his condition. If he is unemployed, he should be looking for a work at the time he became disabled.

• A worker should have earned at least $300 in his State Disability Insurance while he was still working.

• A claimant should be under the care of a licensed medical practitioner during the first eight days of his disability. To continue receiving benefits, a worker should remain under the care of a doctor.

• A licensed medical practitioner must complete a certification of disability to prove that a person has disability. (In some cases, the state will conduct independent medical examination to make sure that there is no fraudulent claim.)

• A worker should fill-out a claim form within 49 days after he has been disabled. According to Los Angeles lawyers, claimants who will fail to meet the deadline may not able to receive their benefits.

REASONS FOR DENIAL OF CLAIMS

• A person is not suffering from wage loss since he is not employed and not currently looking for a job at the time he became disabled.

• A worker is already receiving Paid Family Leave or Unemployment Insurance benefits.

• A person claiming for benefits has been disabled while committing a crime.

• A worker is imprisoned after a court convicted him with a crime of felony which is punishable for at least one year in prison or death.

• A claimant failed to have his doctor sign the disability certification that will prove his condition.

• A person is already receiving the Worker's Compensation benefits which are equal or greater than the amount of State Disability Insurance.

FILING FOR APPEAL

If people have been denied with their claims, they have the right to appeal the decision within 20 days after receiving the disqualification notice.

Denied applicants should fill-out the appeal form and explain that they are qualified to receive claims, or they can also send a letter that explains the reason why they deserve to receive their benefits. (Make sure to include the Social Security number, printed name, signature, and address.)

After receiving the letter of appeal, the state will review again its decision. In some cases, it will send the case to the California Unemployment Insurance Appeals Board local Office of Appeals which will conduct a hearing.
